1. Introduction
Welcome to SkyShadeSprig ("we," "us," or "our"). These Terms & Conditions ("Terms") are applicable when you use our yachting services or visit our website at skyshadesprig.sbs, managed by SkyShadeSprig.
Acceptance of these Terms is required for utilizing our charter services or accessing our Service. Should you not agree with any part of the terms, you will be unable to use the Service.
2. Service Overview
SkyShadeSprig offers a range of luxury yacht charter services including, but not limited to:
- Day-long yacht rentals
- Evening cruises
- Business retreats
- Exclusive gatherings
- Longer charters lasting multiple days
Provision of services is dependent on availability and favorable weather conditions. Service alteration or cancellation can occur at any time.
3. Booking and Reservations
3.1 Booking Process
To arrange a charter, the following is required:
- Must be at least 18 years old
- Must provide truthful and full information
- Must make a payment for the initial deposit as outlined in the reservation confirmation
- Must consent to these Terms & Conditions
3.2 Confirmation
Confirmation of reservations will occur upon the successful transaction and our issuance of a written confirmation. We retain the right to decline service to any individual at our own discretion.
3.3 Availability
Reservations are contingent on the availability of the vessel and appropriate weather conditions. We strive to fulfill your requested dates and timings to the best of our ability.
4. Payment Terms
4.1 Pricing
All charges are provided in € and include all relevant taxes unless stated otherwise. Price changes may be enacted with no advance warning.
4.2 Payment Schedule
- Deposit: required 50% of overall charter cost at the time of reservation
- Balance: Due 48 hours before the scheduled departure of the charter
- Extra fees (if applicable): After the charter is completed
4.3 Payment Methods
We accept a variety of payment methods such as major credit cards, electronic bank transfers, and certified bank drafts, all processes through secure systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancellation occurs more than 72 hours prior to departure: Entire sum reimbursed excluding processing fees
- If cancellation occurs between 24-72 hours prior to departure: 50% of sum reimbursed
- If cancellation occurs less than 24 hours prior to departure: No reimbursement will be provided
5.2 Weather Cancellations
In cases where the weather conditions are considered unsafe by our captain, we will propose the following options:
- Reschedule to another suitable date without any additional charge
- Issue a full refund if rescheduling is not practicable
5.3 Mechanical Issues
Should there be mechanical issues with the designated yacht, efforts will be made to provide a comparable alternative. If we are unable to do so, a complete refund will be awarded.
6. Safety and Conduct
6.1 Safety Requirements
Passengers are required to:
- Adhere to all instructions from the crew
- Utilize any safety gear as needed
- Disclose any medical conditions that may impact their well-being
- Stay within specified areas on the yacht
6.2 Prohibited Items
Items that are forbidden onboard include:
- Containers made of glass
- Illegal substances
- Firearms or any form of weaponry
- Excessive non-alcoholic beverages beyond reasonable consumption
- Pets (unless pre-authorized)
6.3 Conduct
We expect passengers to behave in a manner that is respectful. Charters can be terminated prematurely with no refund given if passenger conduct is deemed unsafe or interrupts others’ enjoyment.
7. Liability and Insurance
7.1 Our Liability
Our responsibility is confined to the payment made for your charter. We are not culpable for:
- Injuries resulting from passenger negligence
- Thievery or destruction of personal belongings
- Indirect, incidental, or punitive consequences
- Delays due to weather or situations outside our authority
7.2 Insurance Coverage
We hold extensive maritime insurance that encompasses both our fleet and operations. It is the responsibility of passengers to have their own personal and travel insurance.
7.3 Assumption of Risk
When you partake in our yacht services, you acknowledge the inherent dangers present in marine activities and agree to accept personal responsibility for your safety.
8. Modifications and Itinerary Changes
We may alter itineraries, routes, or schedules due to reasons like weather conditions, safety concerns, or operational necessities. Efforts will be made to offer comparable substitutes whenever possible.
9. Force Majeure
We are not liable for any delays, cancellations, or changes brought about by forces outside our control, including but not restricted to:
- Extreme weather events
- Natural disasters
- Directives from the government
- Port obstructions
- Vessel malfunctions
10. Privacy and Data Protection
We handle your personal information according to our Privacy Policy. Your use of our services signifies your agreement to our information collection and usage as outlined in the Privacy Policy.
11. Intellectual Property
The materials on our website, such as texts, visuals, logos, and pictures, are safeguarded by intellectual property laws. Unauthorized replication, distribution, or creation of derivative works are prohibited without our explicit written consent.
12. Governing Law
The governing laws of Germany apply to these Terms. All related disputes will be adjudicated in the courts situated within Hamburg, Germany.
13. Changes to Terms
We hold the authority to update these Terms at our discretion. Amended terms will be published on our site with the revisions noted by date. Your continued use of our services after changes indicates acceptance of the new terms.
